Flasher who targeted schoolgirl in street avoids jail

Leo Stewart (20), from Kirkcaldy, was identified following evidence he had a can of a ‘Rockstar’ energy drink when carried out one of the lunchtime offences.

His partner confirmed he returned to her house shortly afterwards carrying a can of the drink.

At the end of the four-day trial in Dunfermline, the jury found Stewart guilty of charges in the two indecency acts which took place ten months apart.

On September 22 last year at Appin Crescent, Kirkcaldy, he intentionally exposed his genitals in a sexual manner to a girl then aged 13 and made a sexual remark to her.

The young girl was so shocked and upset that she went home and locked the door until her mum returned.

On July 15, 2016 at Balfour Street, Kirkcaldy, Stewart again intentionally exposed his genitals to a female and made a sexual remark.

On that occasion he cycled past the victim then turned back and carried out the offence. A police officer saw Stewart on a bike nearby around the same time.

When Stewart returned to court for sentencing, defence solicitor Danielle Valera conceded her client was classed as being a “high risk” of re-offending.

However, she said he had the support of his family and partner and called for a community-based disposal. She added social workers had identified a new home for him in Glenrothes and there was also a bus ticket ready for him if he was released.

Sheriff McSherry imposed a community payback order with 30 months’ supervision.

Restrictions were placed on Stewart having contact with children and he was placed on the sex offenders’ register.
